Deal-analysis pack terms

1. Who we are

We are Reliness Ltd, a company registered in England and Wales, company number 17558426, registered office 17 Hill Close, Barnet, EN5 3AG. Email: ben@reliness.co.uk.

2. Who can order

Packs are sold to businesses only: companies, LLPs and investors buying property in the course of a business. By ordering, you confirm you're acting for your business and not as a consumer.

3. What you're buying

A written deal-analysis pack on one residential property in England that you've identified and sent us. It covers estimated market value, rental evidence and the rent we'd underwrite, a refurbishment scope and cost estimate, yield, cashflow, return on cash, stamp duty, refinance position, the lender's rental-cover test, downside and upside sensitivity, risk flags, and an offer strategy. Figures are estimates based on public and licensed data on the date of the pack. The value figure is our estimate, not a valuation by a RICS Registered Valuer.

4. What we don't do

We never contact the seller, their agent or the auctioneer. We don't arrange viewings, negotiate for you, source property or introduce you to anyone. The pack isn't a valuation (including a RICS Red Book valuation), a survey, or mortgage, tax, legal or investment advice, and it doesn't replace your surveyor, conveyancer or broker. We don't take commercial property, lease options, rent-to-rent, off-plan or overseas property, or property outside England.

5. Turnaround

We deliver within 48 hours of having your payment, the listing or particulars, and your answers on budget, strategy, finance, target area and exit. Orders received at a weekend start on Monday. If the property can't be analysed from the information available, for example with no floor area or no usable sold prices nearby, we tell you before you pay.

6. Price and payment

£195 a property. £145 for the first pack ordered by a company incorporated in the last 90 days. Prices are in pounds sterling. Reliness Ltd isn't VAT registered, so no VAT is added. You pay our invoice in full before work starts.

7. Refunds and corrections

If we don't deliver within 48 hours of having everything we asked for, we refund the fee in full. If a pack contains a factual error we introduced, such as wrong sold prices or wrong arithmetic, tell us within 30 days and we'll correct it free.

8. Using the pack

The pack is for the named client only. Please don't present it to a lender, investor or anyone else as a valuation or as advice to them. You make your own decision on whether to buy and at what price.

9. Liability

Our total liability to you in connection with a pack is limited to the fee you paid for that pack. We aren't liable for loss of profit, lost opportunities or any decision to buy, not buy or pay a particular price. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't lawfully be limited.

10. Your information

We use your details and the properties you send us only to prepare your packs, and we never share your target properties with anyone. Our privacy notice has the details. 11. Complaints

Email ben@reliness.co.uk. We acknowledge every complaint within 2 working days and aim to give a full answer within 10 working days. Our complaints procedure has the details.

12. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

13. Protecting payment

Where anything above conflicts with this section, this section applies.

13.1 Paid before work starts. Packs are paid in full before we start. We don't share values, rents, comparables or any other numbers before payment.

13.2 The free yes or no. If you send a listing before ordering, we'll tell you yes or no on whether it deserves a full pack. That's one property per company, with no reasons and no numbers.

13.3 Who can rely on the pack. The pack is licensed to the named client. You can share it with your own accountant, broker, lender and solicitor for that purchase, as long as it isn't presented as a valuation. Please don't sell it, pass it to other investors, joint venture partners or deal packagers, or use it to market a property. Each extra business that relies on a pack pays the full pack price.

13.4 Corrections, not refunds. A correction claim under section 7 needs to say which figure is wrong and why. We'll recheck it and correct it or confirm it in writing. A change in the market, the agent's figures or your own plans after delivery isn't an error.

13.5 The 48 hour clock. The 48 hours run only while we have everything we asked for. They stop while we're waiting for your answers or documents.

13.6 Late payment. Overdue sums carry statutory interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998.

13.7 Card payments. If you pay by card, you agree to raise any problem with us in writing first and give us 14 days to put it right before you dispute the charge. If a charge is disputed, we'll give the card issuer the order email, these terms, the payment record and the delivered pack. The licence in 13.3 is suspended while a dispute is open. If a charge is reversed, the amount is still owed under these terms and we can recover it.
